Skilled work

H-1B specialty occupation visa

The main professional work visa, capped at 85,000 a year and allocated by an annual registration lottery. From FY2027 the lottery is weighted by wage level, so entry-level graduate salaries get the fewest entries.

Path to settlementNo automatic path; employers normally sponsor EB-2 or EB-3 permanent residence separately, via PERM labour certification.

Requirements and sources
  • Annual cap of 65,000, plus 20,000 reserved for holders of a US master's degree or higher.
  • A US employer must register you and, if selected, file the petition — you cannot apply on your own.
  • From FY2027 selection is weighted by OEWS wage level: Level IV gets 4 entries, III gets 3, II gets 2, Level I just 1.
  • A first job out of university typically sits at wage Level I, the weakest position in the weighted draw.
  • The job must be a specialty occupation normally requiring at least a bachelor's degree in a specific field.
  • A Sept 2025 proclamation added a USD 100,000 payment; on 8 June 2026 a court vacated the agency guidance implementing it, and the appeal court denied a stay on 24 July 2026. DHS is complying while it considers next steps but says it still plans to collect the payment if the order is lifted. Proclamation 11069 of 18 September 2026 extended the 2025 proclamation until 21 September 2027.
How the degree matters
Must be a specialty occupation requiring a specific bachelor's degree or higher, and your degree must match the role. A US master's adds a second chance via the 20,000 advanced-degree cap.

After studying there

F-1 student visa with OPT and STEM OPT

Study in the US on an F-1 visa, then work for 12 months on Optional Practical Training — extendable by 24 months if your degree is on the DHS STEM list and your employer uses E-Verify.

Path to settlementNone directly; OPT is a bridge to H-1B or to employer-sponsored permanent residence.

Requirements and sources
  • Post-completion OPT: up to 12 months of work directly related to your major field of study.
  • STEM OPT extension: 24 extra months (36 total) if your degree is on the DHS STEM Designated Degree Program List.
  • The STEM extension requires an employer enrolled in and actively using E-Verify.
  • Core STEM code series are Engineering (14), Biological/Biomedical Sciences (26), Mathematics and Statistics (27) and Physical Sciences (40).
  • Pre-completion OPT (max 20 hrs/week in term) is deducted from the 12-month allowance.
  • DHS published a final rule on 17 July 2026 replacing 'duration of status' with a fixed admission period (up to 4 years) from 15 September 2026, but a federal court in Massachusetts blocked it with a preliminary injunction on 14 September 2026, so duration of status still applies while the case continues.
How the degree matters
A STEM-listed degree triples post-study work time from 12 to 36 months, which in practice means roughly three shots at the H-1B lottery instead of one.

Other

O-1 visa for individuals with extraordinary ability

For people already at the very top of their field. Applicants must show extraordinary ability through sustained national or international acclaim, so a degree or a strong academic record on its own does not qualify.

Path to settlementNo direct path, but O-1 holders often go on to qualify for EB-1A extraordinary-ability permanent residence.

Requirements and sources
  • O-1A covers sciences, education, business and athletics; O-1B covers the arts.
  • O-1A requires 'extraordinary ability' — being among the small percentage who have risen to the very top of the field.
  • You must document at least three regulatory criteria (major awards, published material about you, judging others' work, high salary).
  • Requires a US petitioner (employer or agent); you cannot self-petition.
  • A new graduate qualifies only with documented sustained national or international acclaim; a degree on its own does not meet the standard.
How the degree matters
A degree alone counts for little; what matters is sustained national or international acclaim — publications, major awards, press coverage.

J-1 Exchange Visitor (Intern and Trainee)

Exchange visitor visa. The Intern and Trainee categories suit recent graduates, but the two-year home-residency rule can force you back to South Africa for two years afterwards.

Path to settlementNone; and 212(e), if triggered, actively blocks a green card until you serve the two years or obtain a waiver.

Requirements and sources
  • The Intern category targets current students and recent graduates; Trainee requires a degree plus professional experience.
  • Requires a State-Department-designated sponsor organisation, not simply an employer.
  • INA 212(e) can impose a 2-year home-residency requirement before you can move to certain other visas or a green card.
  • 212(e) is triggered by government funding, graduate medical training, or a field on the Exchange Visitor Skills List for your country.
  • South Africa is not on the current Exchange Visitor Skills List (State Department public notice, applicable from 9 December 2024), so for South Africans 212(e) is triggered only by government funding or graduate medical training.
How the degree matters
Intern and Trainee eligibility is tied to having, or nearly having, a post-secondary degree. The Skills List, which ties 212(e) to a field, does not currently include South Africa.

Employment-based permanent residence (EB-2 / EB-3)

Employer-sponsored permanent residence. Most graduates reach it via EB-2 or EB-3 after time on H-1B, normally requiring PERM labour certification proving no US worker is available for the role.

Path to settlementThis IS the permanent residence route; naturalisation generally follows 5 years after obtaining the green card.

Requirements and sources
  • EB-2: an advanced degree, or a bachelor's plus 5 years' progressive experience, or exceptional ability.
  • EB-3: skilled workers and professionals. In the October 2026 Visa Bulletin, EB-3 for 'All Chargeability Areas' has a final action date of 15MAY24 and EB-2 one of 01JAN25 (EB-2 was current, 'C', in the July 2026 bulletin), so both have a queue and the EB-3 queue is longer.
  • PERM labour certification via DOL Form ETA-9089 is normally required, unless the role falls under Schedule A.
  • A National Interest Waiver lets some EB-2 applicants self-petition without a job offer or PERM.
  • South Africa falls under 'All Chargeability Areas' in the Visa Bulletin — no India- or China-style country backlog.
  • The dates above are the final action dates in the October 2026 Visa Bulletin; the bulletin is republished every month, so check the current one.
How the degree matters
Degree level sets the category: a master's, or a bachelor's plus 5 years' progressive experience, reaches EB-2, whose final action date for 'All Chargeability Areas' in the October 2026 Visa Bulletin (01JAN25) is later than EB-3's (15MAY24), so its queue is shorter.

Diversity Visa Program (green card lottery)

The green card lottery. South Africa is not on the published list of ineligible high-volume countries, so South Africans are eligible to enter when an entry period is open — long odds, but it is a direct route to permanent residence. As at October 2026 no DV-2027 entry period has opened and the lottery is not accepting entries.

Path to settlementGrants permanent residence directly if you are selected and complete consular processing successfully.

Requirements and sources
  • From DV-2027, every entrant pays a USD 1 registration fee when submitting the entry (no waivers; State Department fee rule, effective 16 September 2025) and must give valid passport details and upload a scan of the passport's biographic and signature pages, subject to limited exemptions (State Department final rule, effective 10 April 2026). Entries can only be submitted electronically on the State Department's Electronic Diversity Visa website (dvprogram.state.gov) during the annual entry period.
  • The DV-2027 entry period, normally held in October, has not opened: in November 2025 the State Department said it would announce the dates 'as soon as practicable', and as at October 2026 no DV-2027 or DV-2028 entry instructions had been published in the Federal Register. New dates are announced on the State Department site.
  • Requires a high school education, or two years of qualifying work experience.
  • Ineligible countries are those that sent more than 50,000 immigrants to the US in the previous 5 years.
  • South Africa was listed as eligible in the DV-2026 instructions (Federal Register 2024-22482), the latest published; no DV-2027 instructions had been published in the Federal Register as of 4 October 2026.
  • Selection does not guarantee a visa — selectees must still qualify and visa numbers are limited.
How the degree matters
A degree is not required; a completed high school education suffices, making this one of the few US routes where qualifications barely matter.
